Η εποχή μας χαρακτηρίζεται από το γεγονός ότι τα δεδομένα, δηλ. οι ψηφιακές πληροφορίες, η παραγωγή των οποίων σήμερα έχει αυξηθεί εκθετικά, έχουν καταστεί κινητήρια δύναμη της οικονομίας, ή άλλως, σημαντικός πόρος για την οικονομική ανάπτυξη. Η οικονομία των δεδομένων καταλαμβάνει σημαντική θέση στο ΑΕΠ των σύγχρονων κρατών και συμβάλλει στη δημιουργία θέσεων εργασίας και τη βελτίωση της ποιότητας ζωής του σύγχρονου ανθρώπου. Η νέα ψηφιακή οικονομία ή οικονομία των δεδομένων, που ενίοτε αναφέρεται και ως «Βιομηχανία 4.0», περιλαμβάνει πολλές αναδυόμενες τεχνολογίες, οι οποίες δρουν ανατρεπτικά, αλλάζοντας καθεστηκυίες δομές και πρακτικές.
Στο βιβλίο αυτό θα επιχειρείται η προσέγγιση των νομικών ζητημάτωνπου ανακύπτουν από την οικονομία των δεδομένων, με μια διακλαδική προσέγγιση που καλύπτει πτυχές εμπορικού δικαίου, αστικού δικαίου, ζητήματα προστασίας δεδομένων προσωπικού χαρακτήρα κ.λπ.. Οι ρυθμίσεις για τις ηλεκτρονικές συναλλαγές αναλύονται σε προηγούμενες μελέτες του συγγραφέα (βλ. Ι. Ιγγλεζάκη, Δίκαιο Πληροφορικής, δ΄ έκδ., 2021, Εκδ. Σάκκουλα, Το νομικό πλαίσιο του ηλεκτρονικού εμπορίου, 2003, Εκδ. Σάκκουλα και Το δίκαιο του ηλεκτρονικού εμπορίου–Επιτομή, 2009). Στην παρούσα μελέτη αναλύονται ειδικά ζητήματα σε σχέση με τις αναδυόμενες τεχνολογίες της οικονομίας των δεδομένων, τα οποία δεν έχουν απασχολήσει σε επαρκή βαθμό την Ελληνική επιστήμη και βιβλιογραφία. Επισημαίνεται ότι οι νομικές ρυθμίσεις για τα νομικά αυτά ζητήματα υφίστανται, προς το παρόν, υπό μορφή προτάσεων της Επιτροπής της ΕΕ για τη θέσπιση Κανονισμών και άλλων νομικών πράξεων, δηλ. το ρυθμιστικό πλαίσιο είναι ρευστό, ενώ και η νομολογία των Δικαστηρίων είναι κυμαινόμενη.

Στην 3η έκδοση του βιβλίου καλύπτονται αναλυτικά οι διατάξεις του Κανονισμού, ενώ γίνεται ανάλυση και των σχετικών διατάξεων του Ν. 4624/2019 που περιέχει τα μέτρα εφαρμογής του Κανονισμού. Legal Issues related to the Commercial Exploitation of Apps
Abstract: Mobile applications (Apps) are a billion-dollar industry with myriad uses in everyday life. To ensure the successful commercialization of apps, one must study the peculiarities of the Apps market. Contract law issues and copyright law issues related to mobile apps are at the epicenter of this problematic. In the first part of the paper, the various actors engaged in the distribution of applications are identified and the role of the app stores as online platforms – marketplaces is analyzed. The End-user (consumer) is the reference point of the legal approach to interpret the relations created and classify the contract typology. In addition, the operational and technical functionalities of an app store, the terms and conditions, its organizational structure, the types of applications ‘sold’ or ‘licensed’ and payment methods applied, are several of the factors which are weighed upon, in an attempt to define the legal provisions applied on a national level. The second part of the paper focuses on copyright law issues arising from the fact that apps fall under the definition of software. In particular, the evolution of traditional copyright concepts such as the ‘exhaustion of rights’ and ‘first sale’ doctrine, in the context of App Markets, are analyzed. The analysis conducted indicates that, for the time being, application of traditional rules in the app environment does not contribute to legal certainty. Ad hoc cases which would constitute res judicata are rare. Rather, the solution must be sought on a caseby-case basis, and by careful consideration of multiple factors, including organizational and technical characteristics of the app stores.

Abstract
The right to be forgotten is a new right that is introduced in the General Data Protection Regulation (Regulation 2016/679), which has been widely discussed. Critics, on the one hand, disagree with its necessity and hold the view that it represents the biggest threat to free speech on the Internet in the coming years. Viviane Reding, former EU Justice Commissioner and former Vice-President of the EU Commission, on the other hand, describes this right as a modest expansion of existing data privacy rights. The Court of Justice of the EU with its decision of 13 May 2014 in case C-131/12 confirmed this view, interpreting the provisions of Directive 95/46/EEC in such a way as to include a right ‘to be forgotten’ on the Net. The case refers particularly to search engines and their obligation to remove links to web pages from their lists of results, following requests of data subjects on the grounds that information should no longer be linked to their name by means of such a list and taking into account that even initially lawful processing of accurate data may, in the course of time, become incompatible with the directive where those data are no longer necessary in the light of the purposes for which they were collected or processed. This ruling addresses only one aspect of the ‘right to be forgotten’, which concerns the role of Internet Intermediaries, but has wider implications that need to be examined.
